1. Acceptance of terms

By accessing or using DMV IQ (the “Service”), including the website at dmv-iq.com and any associated mobile applications, operated by Oddly Sunny (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

Age requirement: You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. We do not knowingly collect personal information from children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA).

By creating an account, making a purchase, or continuing to use the Service after any updates to these Terms, you confirm your acceptance electronically. This electronic acceptance has the same legal effect as a handwritten signature under applicable law, including the U.S. Electronic Signatures in Global and National Commerce Act (E-Sign Act).

2. Service description

DMV IQ is an educational study tool that provides practice questions, tests, and readiness analytics to help users prepare for US state DMV written examinations across three vehicle types: car, CDL (commercial driver's license), and motorcycle. The Service includes both free and paid (“Pro”) features accessible through our website and mobile applications.

3. No government affiliation

DMV IQ is an independent, private educational service. We are not affiliated with, endorsed by, or associated with any state Department of Motor Vehicles (DMV), Department of Public Safety (DPS), Bureau of Motor Vehicles (BMV), or any other federal, state, or local government agency.

Our practice questions are written based on information from publicly available state driver handbooks and manuals. They are designed as educational study aids and do not represent actual DMV test questions. Your state's official driver handbook remains the authoritative source for all driving laws and test content.

We do not guarantee that using DMV IQ will result in passing any official licensing examination. Test outcomes depend on many factors including individual study habits, the specific questions on your exam, and current state regulations.

4. Account responsibility

If you create an account or make a purchase, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorized use of your account. We are not liable for any loss or damage resulting from unauthorized access to your account that is not caused by our negligence.

5. Limited use license

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial educational purposes, subject to these Terms. This license does not include any right to resell, sublicense, or commercially exploit the Service or its content.

You agree not to:

  • Copy, reproduce, distribute, or publicly display any content from the Service, including questions, explanations, or scoring data
  • Use automated tools, scripts, bots, or scrapers to access, extract, or download content from the Service
  • Reverse engineer, decompile, or disassemble any part of the Service or its underlying algorithms
  • Share, transfer, or allow others to use your account or Pro access
  • Use the Service for any commercial purpose, including creating competing products or services based on our content
  • Interfere with or disrupt the Service, its servers, or networks connected to the Service
  • Upload or transmit any malicious code, viruses, or harmful data through the Service

We reserve the right to suspend or terminate your access to the Service at any time if we reasonably believe you have violated any of these Terms, with or without notice.

6. Payment terms

  • Pro plans are one-time purchases, not subscriptions. There is no auto-renewal.
  • Access durations are 7 days, 1 month, or 3 months depending on the plan selected. Access expires at the end of the purchased period.
  • All payments are processed securely by Stripe. We do not store or have access to your full payment card details.
  • 48-hour refund policy: If you are not satisfied, you may request a full refund within 48 hours of purchase by contacting us at [email protected]. After 48 hours, all sales are final.
  • Prices are listed in US dollars and may change at our discretion. Price changes do not affect existing purchases.

7. Intellectual property

All practice questions, explanations, hints, scoring algorithms, the IQ Readiness Score™ system, design elements, logos, and other content on DMV IQ are the intellectual property of Oddly Sunny and are protected by United States and international copyright, trademark, and other intellectual property laws. The DMV IQ name and logo are trademarks of Oddly Sunny and may not be used without our prior written permission.

Your purchase of a Pro plan grants you a personal, non-transferable, non-exclusive license to access the content for the duration of your plan. This license terminates when your plan expires or if your access is terminated under these Terms.

Copyright infringement notices:

If you believe any content on DMV IQ infringes your copyright, you may submit a notice in accordance with the Digital Millennium Copyright Act (DMCA) by contacting us at [email protected] with: (a) a description of the copyrighted work you claim has been infringed; (b) the URL or location of the infringing material; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

8. Third-party links and services

The Service may contain links to third-party websites, including state DMV websites, driver handbook sources, and payment processors. These links are provided for your convenience and do not imply our endorsement of or responsibility for the content, products, or services offered by those third parties. We are not liable for any loss or damage arising from your use of or reliance on any third-party website or service. Your interactions with third parties, including any purchases or data you share, are solely between you and the third party.

9. Disclaimers

  • The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not guarantee the accuracy, completeness, or timeliness of any content. Driving laws change frequently, and there may be a delay before our content reflects those changes. Always consult your state's current driver handbook for the most up-to-date information.
  • No pass guarantee: Using DMV IQ does not guarantee that you will pass your state's DMV written examination. The Service is an educational supplement, not a substitute for studying your state's official driver handbook.
  • Your IQ Readiness Score™ is a statistical estimate based on your practice performance across multiple dimensions. It is intended as a study tool and progress indicator, not a prediction or guarantee of your actual test result.
  • We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of liability

To the maximum extent permitted by applicable law, Oddly Sunny and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of (or inability to use) the Service, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any and all claims arising from or related to the Service shall not exceed the total amount you have paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty US dollars ($50), whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Oddly Sunny and its officers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content or information you submit or transmit through the Service.

12. Dispute resolution

Informal resolution first: If you have a dispute with us, you agree to contact us first at [email protected] and attempt to resolve the dispute informally for at least 30 days before initiating any formal legal action.

Governing law: These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Jurisdiction: If informal resolution is unsuccessful, any legal action or proceeding arising from these Terms or the Service shall be brought exclusively in the state or federal courts located in San Francisco County, California. You consent to the personal jurisdiction of those courts.

Class action waiver: To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Oddly Sunny.

13. General provisions

  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Oddly Sunny regarding the Service and supersede all prior agreements, understandings, and representations.
  • Severability: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
  • No waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by Oddly Sunny.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Force majeure: We shall not be liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, cyberattacks, or other force majeure events.
  • No third-party beneficiaries: These Terms do not create any rights for any person or entity that is not a party to this agreement.
  • Changes to these Terms: We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
